The inspector’s account

Interviews and record review indicate that all four (4) of four (4) clients reported they are allowed to use the backyard at their discretion. However, clients stated that staff informed them the licensee prefers clients use the garage or front yard instead of the backyard due to reported noise concerns. All clients stated they understand this preference and did not express any concerns regarding the licensee’s or staff’s request to use alternative areas of the facility. During the visit, LPA observed one (1) client exit to the backyard, walk around briefly, and return inside the facility. Staff remained near the sliding door and visually monitored the client until the client reentered the home.

Interviews with five (5) staff members indicated that all clients are permitted to access the backyard at any time. Staff stated that, in response to reported concerns regarding noise levels, they ask clients if they are willing to use the garage or front yard for activities. Staff further stated they explain the situation to clients and request that clients either use alternative areas of the facility or keep noise levels low while in the backyard. Staff also reported that clients have not expressed concerns regarding the use of alternative areas or doing other activities.

LPA interviewed one (1) neighboring individual, who did not report any concerns regarding clients being denied access to outdoor areas or staff creating excessive noise. LPA attempted to interview an additional neighboring individual; however, there was no response.

LPA reviewed camera footage from 04/23/2026 through 04/30/2026 between the hours of 6:00 a.m. and 12:00 a.m. The footage showed staff filling and emptying mop buckets in the early morning, typically before 7:00 a.m. Clients were observed entering and exiting the backyard at various times throughout the day. No clients or staff were observed in the backyard after 10:00 p.m. Based on the information obtained during the investigation, the Department does not have sufficient evidence to corroborate the allegation. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the above allegation, “Staff do not allow clients access to facility backyard” is deemed Unsubstantiated at this time.
