Complaint Investigation Report

On 12/09/2022, at 10:23am, LPA Peraldi conducted an interview with the Administrator. The Administrator stated there had not been any issues with the participants recently. The Administrator explained that on 12/07/2022, she received a call from staff at the facility where C1 lives. The staff at C1’s facility explained that C1 reported a staff from the day program touched them inappropriately in the bathroom on 12/05/2022. The Administrator stated 1 staff accompanied C1 to the bathroom that day. C1’s facility staff told the Administrator that C1 alleged to 1 – 2 staff touching them. The Administrator stated that C1 has not complained about a staff at the day program. The Administrator stated that C1 is pretty independent and that they usually work on crossword puzzles and word searches. C1 does ask staff to accompany them to the bathroom and sometimes does need assistance with toileting. C1 is able to transfer on own from the wheelchair to the toilet. The Administrator also explained that C1 has a history of making false statements.

On 12/23/2022, Investigator Real conducted an interview with C1. C1 informed the Investigator that they attend the adult day program at Oceanview Workshop & Recreation Center. C1 could not recall how long they attended the day program. C1 stated they liked attending the day program and had no complaints to report. C1 stated the staff treat them and the other clients very well and none of the staff have touched C1’s breasts. C1 stated they have never been harmed by any of the staff at the Oceanview facility. C1 stated they feel safe at the facility and have never seen any of the staff harm any of the clients. C1 had no negative information to report regarding the Oceanview facility or any of the staff there. C1 disclosed no sexual or physical abuse.

On 01/24/2023, LPA Emily Peraldi interviewed the complainant, who stated that C1 stated that C1 felt safe at the day program. The complainant stated that C1 did not disclose any concerns of possible sexual or physical abuse.

On 01/26/2023, LPA Emily Peraldi interviewed day program staff who assist C1 with toileting to ascertain their role. Staff #1 (S1) explained that on 12/05/2022, C1 was acting normal and participated in the activities as usual. S1 stated that S1 took C1 to the restroom and stood outside C1’s bathroom stall just in case C1 needed assists. S1 stated that sometimes C1 does need assistance with toileting. S1 stated that C1 is usually friendly with staff and very thankful towards staff. Additionally, S1 denied any inappropriate touching.
