The inspector’s account

At 1:00 p.m., the LPA, along with the Administrator conducted a physical plant tour. No immediate health and safety concerns were observed during initial visit. On 11/04/2024 at 2:08 p.m., the LPA conducted a telephonic interview with S1. The following was then determined:

Interview with C1 revealed that on 10/30/2024, C1 was in the kitchen while S1 was getting ready to leave their shift. S1 entered the kitchen and hugged C1. C1 stated that the hug caught C1 off guard and made C1 uncomfortable. C1 explained that S1 begged C1 not to tell anyone of the incident. C1 explained that C1 did not go to day program after the incident and stayed in C1’s room all day. Interview conducted with the Licensee revealed that the Licensee arrived to the facility on 10/30/2024 after being told about the incident between C1 and S1 by the Administrator. The Licensee stated that he suspended S1 immediately. The Licensee explained that S1 will not be returning to work at this facility. The Licensee stated that he spoke with C1 and ensured that C1 felt safe. Interview with C1 stated that C1 wants to stay living at the facility and does feels safe and more comfortable since S1 has not returned to work.

Interview with S1 stated that S1 bumped S1’s head with C1 and tapped C1’s shoulder as S1 was leaving the facility on 10/30/2024. S1 confirmed their suspension and stated that S1 will not be returning to the facility. During the course of the investigation, it was unclear the details of the hug as interviews conducted revealed conflicting information. Interviews with other clients did not reveal any concerns with staff. The information obtained during the investigation did not include evidence sufficient to corroborate the allegation. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation, “Sexual Abuse: Staff sexually abused a client while in care” is deemed Unsubstantiated at this time.
