Complaint Investigation Report

It was alleged that staff sexually assaulted client. It was reported that Client #1 (C1) was touched inappropriately by facility staff and the Ventura County Sheriff’s Department (VCSD) was called to investigate. Information gathered during the course of the investigation revealed that very low levels of DNA other than C1’s was found on the swabs used to test C1’s body. Additionally, it was stated that the DNA of another person found on C1’s body was consistent to that of someone who was handling their clothing on laundry day, a person speaking closely, or C1 touching their body after shaking hands with another person. A review of C1’s Physician’s Report (LIC 602A), dated 04/07/2023, lists C1’s diagnoses as intellectual disorder and schizophrenia. Additionally, the LIC 602A identifies C1 as having no problems with being confused and depressed and states C1 is able to follow instructions as well as able to communicate. Interviews conducted with the Administrator revealed they have not had clients express concern or communicate anything regarding sexual abuse since taking over the facility. Interviews with staff revealed C1 is vocal and if something is bothering C1, C1 will not hesitate to let one of the staff know. Interviews conducted with clients revealed that none of the clients have reported any problems or complaints amongst themselves regarding staff. Furthermore, clients stated they have not observed or heard of staff being inappropriate with other clients and displayed no concerns. Based on the information gathered through records reviewed and interviews conducted, there is insufficient evidence to support the allegation, ‘staff sexually assaulted client’ Therefore, this allegation is deemed Unsubstantiated at this time.
