The inspector’s account

Licensing Program Analysts (LPAs) Kelly Dulek and Valeria Conway arrived on October 24, 2025 for an unannounced inspection to follow up on a substantiated allegation of a complaint investigation. The LPAs met with Facility Designees Agnes Gazaryan and Nandita (Ashley) Kumar.

On July 7, 2023, the Department concluded a complaint investigation regarding the following allegation: Facility failed to seek timely medical attention for resident in care, illegal eviction, staff are not sufficient in numbers and competent to provide services necessary to meet resident’s needs, and licensee did not allow resident(s) to select their own health care provider.

The licensee was cited for California Code of Regulations (CCR) 87465(g) Incidental Medical and Dental Care and CCR 87468.2(18) Additional Personal Rights of Resident’s in Privately Operated Facilities.

At the time of the Noncompliance Conference on February 8, 2024, the licensee was informed that a civil penalty may be assessed based on Health and Safety Code §1569.49(f).

The Department has concluded an analysis and has determined that a civil penalty is warranted for serious bodily injury. The Welfare and Institutions Code Section 15610.67 defines serious bodily injury as “an injury involving extreme physical pain, substantial risk of death, or protracted loss or impairment of a function of a bodily member, organ, or of mental faculty, or requiring medical intervention, including but not limited to, hospitalization, surgery, or physical rehabilitation.” This is evidenced by the facility’s failure to provide timely medical care; a violation of personal rights; a failure to appropriately respond when the observation of the
