Regarding the allegation, staff restrained clients in care, according to the reporting party, Staff (name unknown) restrained R1 and R2. No further information was provided by the reporting party.

During the investigation, LPA interviewed staff members. According to staff members interviewed, they have never witnessed staff restrain any clients in care. Staff members denied witnessing R1 and R2 being restrained by a staff.

Regarding the allegation staff left clients unattended, according to the reporting party, staff are leaving the clients unattended to go and have smoke breaks. No further information was provided by the reporting party.

During the investigation, LPA toured the facility and interviewed staff. LPA observed four activity rooms at the program. All activity rooms were observed to have 3-7 staff members depending on the number of clients there were in each room. According to the Program Supervisor, the staff to client ratio at the program is 1:3. Based on staff interviews, there are 4 staff members that smoke outside, however when staff go and smoke, they only smoke for about 5 minutes and there are always other staff members present inside each activity room to supervise and attend to the clients.

Regarding the allegation, staff did not prevent clients from eloping from the facility, according to the reporting party, clients have eloped from the day program. No further information was provided by the reporting party.

During the investigation, LPA interviewed staff. According to staff interviewed, there has not been any incidents where clients eloped from the facility. In addition, it was indicated that there is always a staff in the hallway floating around as a "neighborhood watch" to ensure clients in the hallways are being redirected back into their activity rooms.

Based on observations and interviews conducted, the department has determined that although the above allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegation is UNSUBSTANTIATED.
