The inspector’s account

The Licensee indicated there was an incident where R1 recorded the staff and residents with their cell phone without the permission of the staff or residents. The Licensee stated after this incident R1 started speaking loudly to the staff and the residents, and the staff and residents avoided R1. Additionally, the Licensee, stated although R1 has only resided at the facility briefly, they have violated the community house rules. Including engaging and harassing behaviors of residents and staff, speaking rudely to staff and residents, and making false allegations against staff and residents. Information obtained from interviews with staff members indicated they are aware of the incident regarding R1 and it did take place in the dining hall. Staff stated R1 arrived at the dining hall with their pet and was informed pets are not allowed in the dining hall, and R1 became upset. Information received from interviews with additional staff indicated R1 refuses to meet with the management team to discuss the behavior. Additionally, staff indicated R1 moved into the facility without informing the management at the time of admissions they had any pets. When interviewed, R1 stated there were no concerns or challenges with how the facility is run. Additionally, R1 indicated there were no challenges or concerns with the other residents. R1 stated the only problem they have with the staff who work in the kitchen. Information obtained from interviews with additional residents indicated there were concerns and challenges with R1. LPA’s review of the record, written statements from residents to the Licensee, confirmed this. Information obtained from interview with witness indicated they have worked directly with R1 for over seven years. Due to their behaviors, they are hard to get along with. Additionally, the Witness indicated R1 is angry all the time, and they are intimidating. Further information obtained from the witness indicated R1 is challenging and difficult to get along with. Additionally, the Witness indicated they were present during the incident in question, and they did not observe the kitchen staff yelling at R1. The Witness indicated the staff were professional and polite and due to R1’s documented behavior they lash out at others. LPA’s review of the records confirms information provided regarding the numerous requests and attempts to meet with R1 to discuss the facility guidelines and contractual agreements made at the time of admission. LPA’s review of the records, including emails, and written statements from other residents, established there were documentarians notating the incidents. LPA conducted subsequent interview with the Witness, and they advised they were aware of the challenges and concerns R1 was displaying. Additionally, the Witness indicated there were several concerns regarding R1’s behavior while residing at the facility, and thus the need to assist with a plan for relocation.

Based on information obtained from interviews, record reviews, and observations, the evidence received pertaining to the allegations, Staff did not treat the resident with dignity and respect, and Staff did not provide a comfortable environment for the resident, has been deemed unsubstantiated. An unsubstantiated allegation means although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur. An exit interview was conducted. A copy of this report was discussed and given to the Licensee, Amber Rodgers.
