The inspector’s account

On 6/24/2025, Licensing Program Analyst (LPA) Janette Romero conducted an unannounced case management visit to address a deficiency observed while investigating a complaint in the facility. LPA met with Human Resources (HR), Mary Avila and Facility Manager (FM), Elizabeth Martinez who were informed of the purpose of the visit.

While reviewing the staff roster, LPA found Staff 1 (S1) is a direct care professional intern at the facility without having a criminal record clearance or exemption. HR reported the facility believed S1 did not require a criminal record clearance because they are under the age of 18. HR added S1 reported they have submitted their fingerprints for a criminal record clearance and are waiting for the results. LPA reviewed S1's onboarding documents listing their hire date as 6/16/2025. HR reported S1 has only physically worked in the facility providing care and supervision to the clients since 6/20/2025.

Based on the aforementioned, the facility will be cited and a civil penalty will be assessed. An exit interview was conducted and a copy of this report, LIC 809-D, Confidential Names list (LIC 811) and Appeal Rights were reviewed and provided to FM and HR. A copy of Title 22, regulation sections 82065 Personnel Requirements and 82019 Criminal Record Clearance were also provided for the facility's review.
