Complaint Investigation Report
Per records reviewed on June 2, 2025, S1’s employment was terminated at the facility for refusal to cooperate with a mandated drug urine test due to reasonable suspicion. Per the facility’s Reasonable Suspicion Checklist, on June 2, 2025, S1 was observed to be unresponsive, distracted, unfocused, sweating, and had blank stares with a body odor of marijuana. Per the facility’s checklist, other observations included S1 smokes in living room, restroom, and clients’ rooms. S1’s refusal to complete the mandated drug urine test was documented on the checklist with S1’s signature. Interviews corroborated that S1 was observed smoking marijuana at the facility on multiple occasions during their shifts.
The Department has investigated the above-mentioned allegation and based on interviews and records review, the preponderance of evidence exists to support the allegation. One deficiency is being cited per California Code of Regulations, Title 22 (refer to the attached LIC 9099-D). An exit interview was conducted with DSP Lead Manuel Marquez and District Manager Anne Marie Stanton, to whom a copy of this report, LIC 9099-C, LIC 9099-D, and the Licensee/Appeal Rights (LIC 9058 03/22) were provided to.
