The inspector’s account

Regarding the above mentioned allegation, three(3) staff members, and two(2) clients were interviewed. Staff and client interviews did not corroborate the allegation, as staff stated that they have witnessed no client on client inappropriate touching or behaviors. Staff stated that when it comes to bathroom time for groups, they always have clients in the stall where they aren't being seen as much as possible. Client interviews suggested limited verbal communication and difficulty maintaining topic relevance during conversation, but no statements regarding any inappropriate behaviors.

LPA accompanied by staff, conducted a tour of the facility and observed at least one staff member in each activity classroom. LPA observed cameras throughout the facility within the hallways in some blind spots, and in most of the activity rooms except bathrooms.

Review of the facility records did not corroborate the allegation. LPA review of the staff schedule revealed that there is 1 staff present in all the activity rooms, and 2 staff present in the multipurpose rooms during lunch hours. LPA review of Client 1 (C1)'s file revealed that C1 is frequently confused, and occasionally able to communicate. Facility supervision procedure and participant restroom use acknowledgement records signed by all employees revealed that staff must be aware of participants whereabouts at all times. Staff must be with participants whether they need assistance in the restroom or not, and participants in restroom groups that do not need to use the restroom must wait outside the restroom, be assigned to a buddy, or must stay in communication with staff while staff assists other participants in the restroom. Additional records revealed that an internal investigation was conducted by the facility, and no evidence was found that client on client inappropriate touching occurred. No records were found to give evidence to lack of supervision resulting in client on client inappropriate behaviors.
