The inspector’s account

Interview with staff said that they had not witnessed illegal substances being used at the facility. Interview with Licensee said they were aware R2 used illegal substances outside the facility but were unaware they used any illegal substance at the facility. According to Licensee, R2 walked to a nearby park and upon their return to the facility, R2 was observed as not at their baseline and in an altered state. Licensee said that R1 did not have issues that they were aware of with using illegal substances at the facility. A review of records revealed that R1 did use an illegal substance on or about April 28, 2023, and had elevated levels in lab results. Additional records showed that R1’s physical health status was extensive but did not have current substance abuse. Further records indicated that R1 did have substance abuse history. Records showed R1 was able to leave the facility unassisted. On May 9, 2023, LPA toured the facility with the Licensee and inspected the shared bedroom for R1 and R2. LPA did not observe any illegal substances or drug paraphernalia in R1 and R2’s bedroom. Based on the information obtained there is insufficient evidence to support the allegation.

Based on the Department’s investigation of the above-mentioned allegation and the evidence obtained during staff, resident and outside source interviews, records reviewed, and LPA observations, there is insufficient evidence to meet the preponderance of evidence standard. Therefore, the above allegation is deemed to be unsubstantiated.

The report was discussed, and an exit interview was conducted with Administrator Victoria Legaspi. A copy of this report, Confidential Names list (LIC811), along with Licensee/Appeal Rights (LIC9058 3/22) was provided to Administrator Legaspi at the conclusion of the visit.
