that R1 was ever over medicated and confirmed that all medications are administered according to physician orders.

Staff 2 (S2) was interviewed and also verified that R1 often uses avoidance behaviors, including closing his eyes and remaining still, but is alert and responsive when prompted. S2 stated that R1’s medications have not changed recently and are administered as prescribed.

Resident 1 (R1) was interviewed and stated that he sometimes pretends to be asleep when he does not want to go to the day program or participate in activities. R1 denied feeling sleepy or unwell due to medication.

Outside source interviews revealed that R1’s day program staff initially expressed concern that R1 appeared overly sedated. However, after further observation and communication with the facility, they acknowledged that R1 was engaging in behavioral patterns rather than exhibiting signs of over medication. R1 was observed to be alert and responsive when prompted.

Records review revealed documentation of R1’s current medication regimen, which has remained unchanged for several months. Medication Administration Records (MARs) and centrally stored medication logs showed no discrepancies. All medications were administered in accordance with physician orders.

LPA observations revealed that the facility maintains accurate medication records and that staff are trained in medication assistance per Title 22 regulations. R1 appeared alert and communicative during the visit.

Based on interviews, direct LPA observations, and records review, a preponderance of evidence does not exist to prove that the alleged violation occurred. Therefore, the allegation is UNSUBSTANTIATED.
