The licensee was shown the video on 03/30/22, and the licensee identified the three staff involved in the video as well as the client. The licensee identified the third staff as Staff 3 (S3) who is filming the incident. The video was edited to be shown in slow motion. On 04/04/2022, S2 was arrested and charged with PC 368-Dependent Adult Abuse and PC 245 (a)(4) - Assault by Means Likely to Produce Great Bodily Injury. S2 and S3 plead guilty to felony counts of PC 368. S1 plead guilty to a felony count of 368(b)(1).

Based on review of the video, interviews conducted and records review, the preponderance of evidence standard has been met. Therefore, the allegations of staff hitting client and failing to treat client with dignity and respect is found to be SUBSTANTIATED. A finding that the complaint is substantiated means that the allegation is valid because the preponderance of the evidence standard has been met. California Code of Regulations (Title 22, Division 6 & Chapter 3) are being cited on the attached LIC 9099D).

An exit interview was conducted and a copy of this report, 9099D, appeal rights, and LIC811-confidential names list were reviewed and provided to Licensee/Administrator Manuel Vasquez.
