R1 did not report the incident to facility staff, and said that he/she went straight to local authorities while they were in the facility. It was not until R2 left that the facility employees learned about R2s inappropriate behavior and remarks. All the staff that were interviewed confirmed that they did not know about the remarks and advances made by R2 toward R1 and other residents until R2 left the facility.
Interviews with facility staff all corroborate that none of the residents came forward to report that R2 had been making unwanted remarks toward them or that they were assaulted by them. R2 also denied that he/she made remarks to any of the clients.
There is no sufficient evidence to prove that the facility neglected to supervise R1 and R2. There were no witnesses and none of the clients came forward to report that R2 had made advances or remarks towards them until after he left the facility
Based on interviews and records review, the department has determined that although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are UNSUBSTANTIATED.
