Complaint Investigation Report
The outside source informed the investigator that R1 denied the allegations of assault to the attending physician while in the care at the hospital.
On 03/27/23, Resident 2 (R2) at Carrolls Community Care informed that on numerous occasions they witnessed R1 at the local restaurant associating with known drug users and R2 witnessed R1 “getting high”, R2 said R1 would occasionally try to do drugs in the room at the facility but R2 would not allow it. R2 reported on 03/10/23 that they and R1 slept in their shared room all night and R2 denied anyone entering the room the entire night. On 03/11/23 R1 woke up and reported to Staff 1 (S1) that he had been assaulted.
Staff 2 (S2) reported that R1 was not consistent in taking their prescribed medications which would cause them to become paranoid and delusional. R1 stated that staff conducted hourly status checks on residents to see if they were smoking or using drugs in their rooms. Most of the residents have drug abuse and mental health issues. Facility staff would speak with the residents about curfew however they cannot enforce it. Residents will usually leave the facility use illicit drugs on the streets and return to the facility under the influence. Facility staff will document the incident and report it to the administrator for follow-up.
There were no interviews conducted with R1 during their stay at the hospital and they did not return to Carrolls Community Care. R1 was kept in the hospital until being placed at a different facility on 03/12/23. R1 began elopement from the facility and the staff had difficulty keeping them at the facility. R1 was soon evicted from the new facility and the outside source was notified and R1's location was unknown.
While R1 was hospitalized they had admitted to hospital staff and later to the outside source that they were not assaulted at Carrolls Community Care and the allegations of being forced to take drugs were false. R1's roommate R2 reported no one was in the room with them that evening and R1 did not use drugs while in the room.
Based on the findings of this investigation, the allegations of Lack of supervision resulting in physical abuse and lack of supervision resulting in a client using illegal drugs were found to be unsubstantiated. A finding that is unsubstantiated means that although the allegations may have happened or are valid, there is not a preponderance of the evidence to prove that the alleged violations occurred.
An exit interview was conducted with Administrator. A copy of this report and Licensee's Rights (LIC 9058 03/22) were provided to the Administrator and his signature on this report confirms receipt of the Licensee Rights.
