Other residents would verbalized their disagreement of R1 watching pornography on his phone at the breakfast table and requested R1 to turn off the phone they were watching from. Staff members also verbalized to the administrator that R1's behavior was disturbing. Staff and other residents also verbalized their disapproval of R1 masturbating in open areas of the facility. OS1 stated that R1 was fixated with Staff 1 (S1) and began staring at S1 and following S1 around the facility. S1 stated that R1 also began pointing to their mouth and genital area, which made S1 uncomfortable, and they reported the behavior to the administrator. OS1 was given a note apologizing about fabricating the allegation.

Outside Source 2 (OS2) was interviewed and stated that during the interview with R1, they determined R1 was fabricating that S1 sexually abused them. OS2 stated R1's description of S1 did not coincide with the observations of S1. OS2, determined by their interview with R1, the incident did not occur, and the allegation was fabricated.

Outside Source 3 (OS3) was interviewed and stated they spoke at length with R1, and they stated that they deduced R1 was fabricating the allegation. OS3 stated they are very aware of R1's behaviors and stated R1 has a history of not being truthful.

Resident 1 (R1) was interviewed, and their statements were not consistent with what was reported. R1 changed the dates, times, and events of the allegation. Resident 1's (R1's) medical records were reviewed and confirmed mild to moderate delays in cognitive development and learning. R1 verified that they wrote the notes that stated R1 was not telling the truth about the allegation.

Based on the Department's interviews and record reviews, there is not a preponderance of evidence to prove alleged violations occurred, therefore, the allegations are unsubstantiated.
