The inspector’s account

It is alleged that frozen vegetables are being stored in the refrigerator and that the expired milk is being served to the residents. Review of the food supply did not produce any evidence of expired foods or improper storage. Frozen foods were found to be stored properly in a freezer at zero degrees or less. S1 denies having served expired milk. There was no supporting information obtained through interviews regarding this allegation. It is alleged that S1 is purposely posting menus high on the wall with the intent that it would upset the residents in wheel chairs. LPA observation of a white board with daily menu printed on it as well as paper monthly menu was posted above the white boards. S1 admits to posting the menu on the wall but denies that the intent is to inconvenience any residents. Information received through interviews were conflicting and were insufficient to confirm the intent of the menu posting was intentional to and in violation on the residents personal rights. We have found the complaint allegation is unsubstantiated, although the allegation may have happened or is valid: there is not a preponderance of the evidence to prove that the alleged violation occurred. A copy of this report is being reviewed with and furnished to the facility representative. .
