The inspector’s account

It is alleged that staff do not have criminal record clearance. LPA interviewed staff, interviewed relevant parties, and conducted a records review. Interviews with staff revealed that Staff 8 (S8) provides maintenance and delivers inventory to the facility on a weekly basis. S8 also provides instruction and direction to facility staff on a consistent basis including providing Crisis Prevention Intervention (CPI) training. S8 does not have a criminal record clearance on file with the Department. Based upon the preponderance of evidence, S8 is acting in the capacity of an employee. Therefore, this allegation is SUBSTANTIATED. An immediate civil penalty will be issued.

A SUBSTANTIATED finding is defined as a violation has occurred based on the preponderance of available evidence.

An exit interview was conducted where this report LIC9099, LIC9099C, LIC9099D and Appeal Rights were discussed and a copy provided to Licensee, George Clardy.
