Complaint Investigation Report
During the visit, Client #2 (C2) reported to LPA Brown that no staff at the facility locks them in their bedroom all day and C2 indicated "No, no one does that here, never!" LPA Brown unable to interview two (2) clients as they were in an outing at their Day Program. Client #1 (C1) Conservator reported to LPA Brown that C1 has tendency of false stories and false statements. C1 Conservator added that C1 exaggerates heavily and there's no evidence that staff locks C1 in C1 bedroom all day. C1 conservator indicated "No staff at the home are locking C1 in C1's room all day. C1's living at the home for eight (8) plus years now." Inland Regional Center (IRC) Consumer Service Coordinator (CSC) said "C1 has a history of false statements and C1's false statement behavior has been happening multiple times. C1's false statement behavior keeps on reoccurring." During the facility visit on 03/05/2024, LPA Brown observed all clients' bedroom door without lock. LPA Brown reviewed C1's most recent Annual Individual Program Plan (IPP) Progress Notes and it indicated C1's behavior of making false statements or accusations where C1 fabricate, exaggerate stories or accusing someone of something that is false.
The second allegation indicates Facility staff restricted client to use personal phone. Three (3) of three (3) staffs interviewed indicated that all clients at the facility are free to use their personal phone without restriction and no staff at the facility confiscates a client's phone and restrict a client to use their personal phone. C2 reported to LPA Brown that all of them at the home can freely use their phone anytime they want and no staff are restricting them to use their personal phone." C1 reported to LPA Brown "No staff restricts me from using my phone. I can use my phone anytime." LPA Brown unable to interview two (2) clients as they were in an outing at their Day Program. C1's IRC CSC reported " When I go visit C1 at the home, C1's happy, comfortable and C1 has the phone, staff are not restricting C1 to use personal phone. From my understanding, that's not true that staff are restricting client to use personal phone." During the visit on 03/05/2024, LPA Brown observed C2 with two (2) personal phone and staff not restricting C2 to use personal phone.
Based on the evidence, the allegation that Facility staff locks a client in their bedroom all day (Allegation #1), and Facility staff restricted client to use personal phone (Allegation #2) are UNSUBSTANTIATED. A finding that the complaint is UNSUBSTANTIATED means although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated at this time.
