The inspector’s account

Allegation: Staff sexually assaulted resident. Substantiated

The department conducted record review, and staff and resident interviews to investigate this allegation. Resident (R1) was consistent in their disclosure in multiple interviews, including a forensic interview. R1 disclosed that staff (S1) removed their clothing and touched their private parts more than one time. The incident occurred inside R1’s bedroom in the facility. Multiple witnesses reported R1 does not have a history of lying or making up allegations. R1 has not made an allegation of this nature in the past. S1 denied the allegation they sexually assaulted R1. CCHP conducted a forensic psychological evaluation on R1. Forensic interview has determined that based on R1’s cognitive ability to narrate their experiences clearly and consistently highlights their “sincerity” and “credibility.” R1 demonstrates a cognitive profile that suggests resilience against being coached or manipulated in reporting their sexual assault. Additionally, R1’s impaired memory would make it challenging for them to retain and accurately recall a complex and fabricated story. Based on gathered information, this allegation was found to be Substantiated.

Based on interviews conducted by the department and records reviewed, the preponderance of evidence standards has been met. Therefore, the above allegation is found to be SUBSTANTIATED. Please see LIC9099-D for deficiencies cited today per Title 22 Regulations. Civil penalties shall be assessed if facility does not comply with POC requirements which were issued today.

In addition, civil penalties in the amount of $500.00 are assessed today.
