Complaint Investigation Report
SIR reports that Registered Nurse evaluated R1 and determined that R1 did not have any swelling, discoloration, or other visible signs of injury. Staff were interviewed and indicated that, on August 30, 2025, R1 was very frustrated and yelling regarding another resident. Staff reported that, when they approached R1's room to provide assistance, R1 was telling staff not to hit them while staff stood in the doorway of their bedroom away from R1. Staff chose to give R1 time to calm themselves after the interaction. After the incident, R1 alleged that staff hit them on the forehead. Nurse on duty examined R1's forehead and observed no visible signs of injury. Photos were also taken of R1's forehead to document lack of injury. On August 31, 2025, R1 reported that they had a bruise on their head and their wallet was stolen. SIR states that R1 was observed by Administrator, James Astorga, to have no discoloration, swelling, or visible sign of injury, and R1's wallet was in their possession.
Interviews conducted with staff members S1, S2, S3, S4, and S5, as well as Administrator, indicated that they have never witnessed staff physically abusing a resident or being disrespectful to a resident in care. All staff interviewed denied ever physically abusing a resident or being disrespectful to a resident in care. All staff interviewed denied ever going through a resident's property nor witnessing staff ever going through a resident's property. Interviews with S1, S2, and S3 indicated that they were at the facility during the alleged incident of physical abuse and theft. Interviews with S1, S2, and S3 indicated that they did not witness any staff physically abuse R1 nor go through R1's property at the time of incident. Interview with resident (R2) indicated that they have never observed a staff member being physically abusive to a resident in care, nor has experienced physical abuse from staff. R2 stated that they have never observed staff going through a resident's property, nor has experienced staff going through their property. R2 stated that they are treated well by facility staff and their care needs are being met.
During interview with R1, R1 acknowledged that they had possession of their wallet and was not sure if any money was taken out of their wallet by facility staff. R1 stated a name of the perpetrator during interview and stated that it was their "service coordinator." All staff interviewed indicated that they did not know anyone with the name provided by R1. R1 was not able to provide a physical description of the perpetrator during interview. LPA did not observe any injuries on R1 during interview.
