Home Care Aide administered medication to a client.
Home Care Services Branch (HCSB), Enforcement Analyst (EA), Megan Vigil arrived at the location of the Home Care Organization (HCO) for the purpose of conducting a complaint investigation.
EA Vigil was greeted by Designee Allison Jepson. EA Vigil requested immediate access to the scheduling, databases, and conducted interviews and a comprehensive file review. During the investigation, EA Vigil identified clear and compelling evidence that HCO care staff knowingly approved a Home Care Aide (HCA) to participate in medical training provided by a nurse at a hospital. The training included flushing a PICC line, administering antibiotics, monitoring IV, and other related tasks. These activities are explicitly outside the scope of non-medical companion care and are prohibited for Home Care Aides. The approval and facilitation of such training by the HCO represents a serious violation of statutory requirements and demonstrates a fundamental failure to understand and comply with the limitations of non-medical home care services.
Throughout the course of the investigation, HCO staff were not forthcoming with accurate or complete information regarding the circumstances. Statements were inconsistent and directly contradicted documentation and other evidence reviewed. This lack of cooperation and transparency significantly impeded the investigative process and further supports the severity of the compliance failures identified.
The Licensee arrived during the visit to review the discrepancy report and to discuss the required Plan of Correction. Due to the seriousness of the violations, including the authorization of medical services outside the scope of non-medical companion care, applicable Health and Safety Code sections were cited.
Based on observations, interviews, and record review, the preponderance of evidence standard has been met. Therefore, the allegation is substantiated. An exit interview was conducted, and the 9099 and 9099D reports, along with appeal rights, were provided to the Licensee.
