The inspector’s account

Licensing Program Analyst (LPA) Vincent Moleski arrived unannounced to conduct a case management visit. LPA Moleski met with facility administrator Napoleon Mucha and explained the purpose of the visit.

During a review of Secretary of State (SOS) business filings, LPA Moleski observed that St. Philomena Home Care LLC, the entity which holds the license to this facility, was voluntarily dissolved by managing members Napoleon Mucha and Jemelee Mucha as of September 22, 2016. The LLC's status was listed as 'terminated,' according to Secretary of State records.

22 CCR Section 80063(a)(1) requires that all corporate licensees remain active and functioning in order to ensure the accountability of the licensee. As of now, the licensee, St. Philomena Home Care LLC, is not active or functioning, per SOS business filings.

A new LLC by the name of St. Philomena Homecare II LLC was established by Napoleon and Jemelee Mucha as of January 6, 2016, according to SOS filings. However, LPA Moleski has no documentation of an application having been filed with the Community Care Licensing Division (CCLD) for a change of ownership from the first LLC to the second at the time, as required by 22 CCR Sections 80018 and 80034. Napoleon Mucha said that he and Jemelee were not aware of this requirement, and was not aware they needed to notify CCLD of the LLC's dissolution.

This facility is hereby cited per 22 CCR Section 80063(a)(1). Additional actions may be taken based upon the above findings. An exit interview was held with Mucha. Appeal rights and a copy of this report were left with Mucha.
