The inspector’s account

On June 1, 2023, Licensing Program Analyst (LPA) Vincent Moleski met with Camina Sierras, of Solsie 2 Carehome for a case management visit to follow up on a substantiated allegation of lack of supervision resulting in client being raped.

On February 22, 2022, the Department conducted a complaint investigation regarding the lack of supervision which resulted in a client (C1) being raped.

The allegation was substantiated, and the licensee was cited for a violation of California Code of Regulations (CCR) Title 22, § 80078(a) Responsibility for providing care and supervision. The licensee shall provide care and supervision as necessary to meet the client's needs. The facility was also cited for a violation of California Code of Regulations (CCR) Title 22, § 80072(a)(1)(2) Personal Rights. Each client shall have personal rights which include... (1) To be accorded dignity in his/her personal relationships with staff and other persons. (2) To be accorded safe, healthful, and comfortable accommodations, furnishings, and equipment to meet his/her needs. The licensee did not ensure client C1 is accorded with dignity, safe and healthful accommodations.

On February 18, 2022, between 11:30 p.m. to 12:00 a.m., a client (C2) snuck into C1’s bedroom while C1 was asleep and sexually assaulted C1. According to the police department report, C2 admitted to raping and sexually assaulting C1 while C1 slept in their bedroom. Medical records revealed C1’s sexual assault physical examination is consistent with C1’s report of sexual assault. Both staff who were in the facility at the time admitted that they had fallen asleep when the incident occurred.
