Complaint Investigation Report
9099C-1...A forensic interview was conducted with (C1), who made consistent statements about the time of day the alleged incidents occurred to statements made in the original interview; however, (C1) was not able to provide any details as to what or how the alleged assaults occurred but was able to provide details as to other life events. (C1) also stated (C1) was "asleep" when the alleged events occurred.
Facility documentation was reviewed and supported that staff regularly checked on client (C1) during the night and that (C1) was noted to regularly be on the phone late in the evening, around 2300 hours, when the incidents were alleged to have happened. Narrative charting notes for (C1) also noted (C1) was on the phone or iPad late at night or listening to music. There is no documentation of (C2) going into (C1's) room or these clients having any interactions with each other. Additionally, (C1's) Individual Program Plan (IPP) does not have any references to (C2) or notes relating to interactions with any other clients.
Narrative charting notes and IPP were reviewed for client (C2). The charting notes document the daily activities for (C2). On both the notes and the IPP document, there are no references to (C1) or (C2) having any interactions with each other or any other clients.
Similar allegations were made in March 2023 and were previously investigated, and found to be unsubstantiated due to lack of evidence.
Based on documentation reviewe d and the inconsistencies and discrepancies noted from the forensic interview, there is a lack of evidence to substantiate the allegation, and the allegation is found to be UNSUBSTANTIATED- A finding that a complaint allegation is unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred
There are no deficiencies issued in this report.
