Complaint Investigation Report
While the license number was listed on the company website, it was not listed on the magazine advertisement, which is required by both Title 22 Regulations 81011(a) and Health and Safety Code 1514(b)(1). Therefore, due to record review, the allegation “Licensee is not revealing the license number in all advertisements” is SUBSTANTIATED.
A finding that the complaint is SUBSTANTIATED means that the allegation(s) is valid because the preponderance of the evidence standard has been met.
Due to observations made by LPA Colvin, the facility was cited, and deficiency noted on LIC 9099 D. This is a repeated violation within 12 months (facility cited on 6/21/23) and is therefore subject to a civil penalty in the amount of $250, which LPA Colvin will be assessing today.
An exit interview was conducted where this report and appeal rights were discussed. A copy of this report, LIC 9099D, LIC421FC, and appeal rights were provided to Director Lauren Larkin during the exit interview.
