Staff is not allowing resident to receive phone calls.

Staff confiscated resident's personal item.

Licensing Program Analyst (LPA) Javier Prieto conducted a complaint investigation alleging staff not allowing resident to receive phone calls and staff confiscated resident's personal item. Due to COVID 19 and social distancing the complaint was conducted, via telephone. LPA Prieto spoke with administrator Suzette Manalansan who states resident #1 (R1), has a personal cell phone that R1 is allowed to use while at the facility. Interview with R1 states calls are made and received from facility phone and R1's personal cell phone from outside parties without restrictions or interference from facility staff. The allegation that staff confiscated resident's personal item, is related to R1's cell phone. R1 states that facility staff does not confiscate the personal cell phone and continues to have cell phone in R1's procession.

Based on the information obtained there is not enough evidence that staff is not allowing resident to receive phone calls and staff confiscated resident's personal item. Therefore, the allegations are deemed UNSUBSTANTIATED at this time. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is UNSUBSTANTIATED.
