Complaint Investigation Report
During this investigation, Investigator Sonia Sandoval from the Investigation Branch (IB) interviewed C-1’s Service Coordinator and C-1. Investigator Sandoval also requested a copy of the police report from the Pomona Police Department (report not generated). San Gabriel Pomona Regional Center conducted an investigation and found this allegation to be unsubstantiated. LPA Irra interviewed Staff #1 (S-1) through Staff #3 (S-3). LPA was unable to interview Client #1 (C-1) as C-1 is currently hospitalized. LPA was unable to interview Client #2 (C-2) or Client #3 (C-3) as both were at their day program.
Allegation: Personal Rights/ Staff sexually abused client in care. Per Investigator Sandoval’s investigative report, C-1 recanted the sexual allegation. C-1 has a history of making sexual allegations, recanting and fabricating stories. C-1 had fabricated this allegation because C-1 was unhappy living at this facility and wanted to move out. C-1 has previously made allegations of similar nature and has recanted in the past. Staff interviews revealed that C-1 has a history of fabricating stories (including sexual allegations) and recanting. Staff interviews revealed that C-1 has an individual behavioral plan which addresses fabrication of stories which is being monitored and tracked by staff. Per staff interviews, staff are trained in mandated reporting, zero tolerance and client rights. Interviews and reviewed documentation do not corroborate this allegation.
Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove
the alleged violation did or did not occur, therefore, the allegation is UNSUBSTANTIATED.
