The inspector’s account

LPA interviewed staff, resident and witness (WP). Although S1 stated he did not threatened R1 to take away the outing during the time the crisis happened, S1 indicated that he has told R1 on occasion that if R1 does not control his behavior the licensee will cancel the outing. WP stated that when WP called the facility, WP heard S1 threatened to take away the outing. R1 indicated that he has to earn credit for extra outing for good behavior and will not get one if he's having behavior. LPA spoke with administrator who agreed that redirecting has to be in a positive way.

Based on information obtained, the allegation is substant iated. A finding that the complaint is substantiated means that the allegation is valid because the preponderance of the evidence standard has been met.

Deficiency is cited from Title 22 California Code of Regulations, and listed on 809D. Failure to submit proof of correction by plan of correction due dates, and any repeat violation within 12-month period may result in civil penalty.

Deficiency and plan and proof of correction were discussed with administrator.
