05/25/2023 and conducted by Evaluator Les Xiong

COMPLAINT CONTROL NUMBER: 24-AS-20230525144800

During the course of this complaint investigation LPA interviewed staff and reviewed relevant records. It was determined based on the interviews and records review that the above allegation is SUBSTANTIATED. R1 went to the hospital for 5150. Facility was refusing to accept R1 from the hospital when hospital discharging R1, even if R1 is stable. Facility didn't have an approve 3-day eviction notice, and it's the facility's responsibility to bring R1 back to the facility. Based on LPAs observations and interviews which were conducted and record review(s), the preponderance of evidence standard has been met, therefore the above allegation(s) is found to be SUBSTANTIATED. California Code of Regulations, (Title 22, Division & Chapter number), are being cited on the attached LIC 9099D.”)
