As a result, this facility issued R1 an eviction notice on 11/07/2025 in order to inform R1 that if R1 continued to engage in this behavior then this facility would have no choice but to no longer allow R1 to remain as a resident.

It was learned that the eviction process was finalized and R1 was moved out of this facility on 12/02/2025 to another licensed care facility.

Based on interviews conducted, it was learned that there were no reported incidents where facility staff disrespected R1 while R1 was a resident at this facility. It was learned that facility staff attempted to redirect and assist R1 with complying with house rules since all facility residents were mandated to follow them in order to be in compliance with their individualized care plans.

It was learned that after several AWOLs and the issuance of the 30-day eviction notice, R1 knew that R1's time here as a resident was coming to a close and no longer adhered to the facility rules.

Multiple phone calls were attempted out to R1 without any success.

Multiple phone calls were attempted out to the case worker for R1 without any return calls as well.

As a result of this investigation, this Department found the allegation to be UNSUBSTANTIATED. A complaint allegation finding of Unsubstantiated meant that although the allegation may have happened or was valid, there was not a preponderance of the evidence to prove that the alleged violation occurred.

There were no deficiencies observed or cited at this time.
