Facility Evaluation Report
Licensing Program Analysts (LPAs) Cuadra and Frank arrived unannounced to conduct a Case Management - Other Visit and met with Diana Mendez, Program Manager. The purpose of this Case Management Visit is to follow up on SOC341 report submitted to Community Care Licensing (CCL) on 12/16/24 along with an incident report.
Per SOC341, on 12/10/2024 at approximately 3:00pm, facility staff (S1) approached Police Department and reported that on 12/09/2024, at approximately 2:00pm they have witnessed another staff (S2) performing a physical restraint on participant (P1). S1 reported that S2 hugged P1 from behind and restrained their arms. On 12/11/2024, S2 was placed on a leave of absence and an investigation will be conducted to gather further information. On 12/12/24 an outside agency notified P1's responsible party including cross report sent to pertinent agencies. Police Report #SR-241401. According to SOC341, the facility will continue to monitor and support P1 while at Day Program.
During today’s visit, LPAs were told that after they conducted an internal investigation, it was determined that there was no substantial evidence found that S2 have performed any type of physical abuse to P1. Therefore, S2 have returned back to work on 1/2/25 and received additional staff training. LPA requested a copy of their internal investigation conducted by the facility and staff training records for S2 were obtained. LPA was unable to conduct interviews with staff and participants because they were not present during LPA's visit. Per Program Manager, Participants usually do not have an assigned staff to help them with their daily living activities, but after the incident they have taken precautionary measures by not allowing them to work together anymore. The Department will review documentation received to determine if further actions are needed. Exit interview was conducted with Program Manager and a copy of this report was given.
