The inspector’s account

Allegation: A staff person was working and was intoxicated while at the facility.

Based on statements received and records reviewed, LPA investigated allegation and determined that S1 and S2 were both intoxicated while working at the facility substantiated. Administrator reported that both S1 and S2 no longer work at the facility and were terminated for being intoxicated while at work. They were the only staff on shift at that time. S1 and S2 were found by the oncoming NOC shift staff 3 (S3) on 02/11/2022 at approximately 1146pm, outside the facility gate intoxicated and not supervising clients during their shift. S3 reported that she could smell the scent of alcohol on S2’s breath through her N95 mask. Police report confirmed that both staff members were drinking on the job. Police report confirmed that S1 was transported, by friends to the hospital due to alcohol poisoning. Administrator confirmed that alcohol and drugs are not allowed at the facility.

Based on information obtained during investigation, the preponderance of evidence standard has been met; therefore, the above allegation is found to be SUBSTANTIATED. California Code of Regulations (Title 22, Division 6, Chapter 8), are being cited on the attached LIC 9099D. Administrative actions may occur.

Exit interview completed and two copies for LIC 9099/C/D were provided via e-mail. LPA requested for a signed copy to be returned via e-mail.
