The inspector’s account

During the investigation, it was stated that a resident’s personal rights were violated in that a staff person called a resident (Resident 1) a “Crack-head.” Several staff persons stated that they heard of the allegation but did not witness it. The staff person that was accused of the statement, stated that the statement or language was not used. The resident stated that she does not remember an incident where the staff person made the statement. It is unknown if the resident remembers the incident or not, as it is noted in the resident’s IBSP that she has a poor memory.

Based on the resident’s statements it is noted that although the above allegation mentioned may have happened, or is valid, there is not a preponderance of evidence to prove that the alleged violation occurred, and the findings are Unsubstantiated .
