Home Care Aides/Office staff do not have TB clearance

Enforcement Analyst (EA) Perez returned to the residential address of Star Home Care to discuss the allegations noted above. EA Perez introduced himself to licensee Eva Gonzalez and explained the purpose of the visit. EA Perez was escorted to the office, where the license and business hours were prominently displayed. EA Perez interviewed Eva regarding the onboarding process and the steps the organization takes to ensure compliance with state requirements before assigning caregivers to clients. EA Perez also reviewed personnel and payroll records to verify compliance with licensing requirements.

Based on the records reviewed, EA Perez confirmed that two employees worked for the Home Care Organization (HCO) before receiving background clearance, and one employee worked before obtaining TB clearance.

Based on the EA’s observations and interviews, the preponderance of evidence standard has been met, therefore, the above allegation is found to be SUBSTANTIATED. Health and Safety Code, Division 2, Chapter 13, Article 7, Section 1796.43(a) is being cited on the attached LIC 9099D.

Analyst Perez concluded the visit with an exit interview and provided a copy of the HCS 9099 investigation report along with appeal rights.
