Complaint Investigation Report
On 12/30/2020, from 12:15pm to 12:45pm, Licensing Program Analyst (LPA) Rachel De Leon and Tri-Counties Regional Center (TCRC) Quality Assurance Specialist (QAS) Jeff Edler conducted the initial complaint visit. Due to the situation surrounding the Coronavirus Disease 2019 (COVID-19), and to implement mitigation measures, the complaint visit was conducted virtually by FaceTIme with House Manager Jamie West. LPA De Leon explained the purpose of the visit and requested copies of pertinent documents relevant to the investigation. LPA De Leon determined further investigation was needed.
On 01/05/2021, Investigator Rippe reviewed the Atascadero Police Report #20-3037. The report stated on 12/27/2020, Officer Robert Hammer received a call from the Administrator Jamie West stating they had received information on 12/26/2020 that R1 accused S1 of sexually touching R1. R1 had called R1’s representative to report that R1 had been touched sexually. R1’s representative contacted the administrator on 12/26/2020. Administrator stated during the day, R1 told staff that S1 had touched R1’s “pee pee” and “bottom” the prior night and did not want S1 to come into R1’s room.
The Administrator spoke to R1 about the allegations. R1 said “false” when asked if S1 had touched R1 inappropriately. The administrator further questioned R1 and R1 stated they had made up a story and lied about S1 touching R1. R1 is diagnosed with autism and has accused staff of battering in the past. R1 had previously accused a staff member of hitting R1 but that was unfounded. The investigation was forwarded to Detective Ryan Sloan of the Atascadero Police Department for review.
On 1/12/2021 at 1:34pm, Investigator Rippe spoke with Detective Sloan. Detective Sloan stated R1 disclosed on 12/26/2020 at 5:00pm to Staff #2 (S2) and Staff #3 (S3) that S1 had touched R1 inappropriately. S2 recorded some of the disclosure on video and gave a copy of the recording to the detective. Both staff reported R1’s allegation to the Administrator.
