Additionally, interviews did not reveal witnesses to the alleged event, and further investigation did not reveal corroborated evidence that such incident occurred. As a result, the preponderance of evidence standard is not met, and this allegation is UNSUBSTANTIATED.
Allegation: Staff hit client in care. LPA conducted interviews and record reviews as noted above. Based on these interviews and record reviews, it was revealed that a statement was made of a staff member allegedly hitting a client. Interviews conducted revealed that a staff member tapped a resident's face during an episode of a seizure as an attempt to maintain alertness until emergency personnel arrived. Additionally, interviews conducted did not reveal any corroborated evidence of other actions involving staff members hitting clients in care. As a result, the preponderance of evidence standard is not met, and this allegation is UNSUBSTANTIATED.
Allegation: Staff did not allow a client in care to leave the facility. LPA conducted interviews and record reviews as noted above. Based on these interviews and record reviews, it was revealed that resident1 (R1) was asked by a friend to move to another facility. Further interviews revealed that R1 did not wish to move and denied being verbally or physically prevented by staff from leaving the facility in any fashion. Additional interviews did not reveal any corroborated evidence that R1 or any other client was not being allowed to leave facility. As a result, the preponderance of evidence standard is not met, and this allegation is UNSUBSTANTIATED.
An unsubstantiated finding means the allegations may have happened or are valid, but there is not a preponderance of the evidence to prove that the alleged violations occurred.
An exit interview was conducted with Administrator and a copy of this report was provided.
