Further interviews with S2, S3, S4, and additional witness did not result in corroborated evidence to prove the allegation. As a result, the preponderance of evidence standard is not met, and this allegation is UNSUBSTANTIATED.

Allegation: Staff are making inappropriate comments towards resident. LPA conducted interviews and record reviews as noted above. Based on these interviews and record reviews, it was revealed that S1 has contact with R1 and R2 in relation to general job duties. Additional interviews were conducted with S2, S3, S4. A facility observation was also conducted as stated above. The interviews, observations, and record reviews conducted revealed that although S1 had regular contact with R1 and R2 including various conversations, there is no conclusive evidence to prove these conversations included inappropriate statements. As a result, the preponderance of evidence standard is not met, and this allegation is UNSUBSTANTIATED.

Allegation: Staff is inappropriately entering residents rooms. LPA conducted interviews and observations as noted above. Interviews were conducted with S1, S2, S3, S4 as well as R1, R2, and R3. Based on these interviews it was revealed that although S1 enters resident rooms as part of S1’s general job duties, there were no corroborated statements or evidence to suggest resident rooms were entered into in an inappropriate manner. As result, there is not a preponderance of evidence to prove the above allegation occurred. As a result, this allegation is UNSUBSTANTIATED.

A finding of unsubstantiated means the allegation may have happened or is valid, but there is not a preponderance of the evidence to prove that the alleged violation occurred.

An exit interview was conducted with Administrator and a copy of this report was provided. Appeal rights provided.
