Facility Evaluation Report
Licensing Program Analyst K. Hiratsuka, conducted this case management visit in response to complaint investigation 59-AS-20250324162310.
The complaint was substantiated involved two staff attempting to force a resident to take a shower by holding the resident by the waist and wrist while leading the resident to the shower. A third staff member intervened and the other two left the room. The resident did not suffer any injuries.
During the investigation, it was learned the facility did not report the incident to Community Care Licensing Division, local law enforcement, or the local ombudsman per Title 22 Regulation 87211(c) Reporting Requirements: Any suspected physical abuse that does not result in serious bodily injury of an elder or dependent adult shall be reported to the local ombudsman, the corresponding licensing agency, and the local law enforcement agency within twenty-four (24) hours as required by Welfare and Institutions Code Section 15630(b)(1). They did not notify the responsible party either per Title 22 Regulations 87468.1(a)(8) Personal Rights of Residents in All Facilities. Residents in all residential care facilities for the elderly shall have all of the following personal rights: To have their representatives regularly informed by the licensee of activities related to care or services, including ongoing evaluations, as appropriate to their needs.
The following deficiencies are cited as per Title 22 Regulations. Appeal rights given, exit interview conducted.
