Staff did not prevent residents from engaging in physical altercations
Interviews conducted indicated that Resident R1 has been living at the facility since 2023. R1 has a history of violent tendencies. Staff are aware and attempt to calm the situations when there are conflicts in the home with R1 and other residents. Interviews with staff member S1 indicated that R1 will engage in physical altercations with other residents which has made both the staff and other residents in the home fearful. Staff at the facility are following protocols and are calling the police when there are physical altercations within the home. Staff and the facility Administrator are working with R1’s placement agents to see if there is a home that might be better fit for R1. Therefore, the allegation that staff did not prevent residents from engaging in physical altercations is unsubstantiated.
Staff did not prevent residents from engaging in inappropriate behaviors
Interviews conducted indicated that there has been multiple discussions with R1 in regards to following the house rules and acting appropriately in the home. In review of documents, there are multiple incident reports and daily notes stating that R1 is not following the house rules and engaging in inappropriate behaviors like consuming alcohol and smoking marijuana. Facility staff, Administrator and Alta California Regional Center(ACRC) agents have had multiple discussions with R1 but have not seen any changes in their behaviors. Staff and the facility Administrator are working with R1’s placement agents to see if there is a home that might be better fit for R1. Therefore, the allegation staff did not prevent residents from engaging in inappropriate behaviors is unsubstantiated.
Based on interviews conducted, observations, and records reviewed, the preponderance of evidence standards have not been met. Therefore, the above allegations are found to be UNSUBSTANTIATED. A finding that a complaint allegation is unsubstantiated means that, although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred.
