This is an official report of an unannounced visit/investigation of a complaint received in our office on

01/18/2024 and conducted by Evaluator Todd Tryon

COMPLAINT CONTROL NUMBER: 59-AS-20240118120524

Neglect/Lack of Care and Supervision: resident was sexually assaulted by another resident while in care.

On July 9/4/2024 LPA Tryon visited the facility to deliver the findings of the complaint investigation. LPA met with Kirstin Atkins. The Department has investigated the above allegation.

Video footage from the facility was reviewed, and no evidence was found to support the allegation.

Upon interviewing staff and residents, no witnesses were found who could offer any evidence to support the allegations. It was also found that the alleged victim’s story had changed from when it was first told. The conservator for the alleged victim refused to allow the alleged victim to be interviewed for the alleged victim’s own protection. The public defender for the alleged perpetrator refused to allow the alleged perpetrator to be interviewed due to mental capacity and the fact that the person might incriminate self. The Placer County Sheriff’s Dept. did not investigate the allegation due to the alleged perpetrator’s conservator refusing to allow interview of the alleged perpetrator. Therefore, the allegation is found to be UNSUBSTANTIATED. A finding of unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred.
