Complaint Investigation Report
Per IPP dated 04/27/2022 Client (C1) was readmitted back into facility in 02/24/2022 after returning from hospitalization. Current IPP dated 04/27/2022 for C1 notes that C1 has non-compliant behaviors such as answering no to all questions and commands. The IPP further notes that although C1 has non-compliant behaviors with encouragement will perform tasks when prompted.
It was reported on 05/06/2022 that Staff 1 (S1) made remarks indicating they would not provide C1 with their medications. It was also reported by a witness that negative remarks were made towards C1. It was reported by witness multiple negative remarks that were inappropriate were made throughout the day to C1.
During interview with Administrator Armando Flores, Administrator stated has not had any issues with S1 and was not present for the day of the incident. Based on medication records reviewed for May 2022, all medications were given to C1 as prescribed. Interviews conducted with 2 out of 2 staff that have interacted with S1 and C1 indicated they have not witnessed any issues with medications not being provided or remarks made towards clients. During the visit, LPA observed C1 who appeared well groomed and dressed. During interview C1 shook their head no and would not answer LPA’s questions. C1’s responsible party expressed they did not have any concerns about C1’s care and they feel that C1 is in the right place. Client 2 (C2) was unable to be interviewed due to not being able to answer beyond yes and no. S1 denied the allegations of refusing to administer medications and violation personal rights of C1.
Therefore based on the preponderance of evidence gathered, interviews conducted and records reviewed and observations made the allegations facility had a failure to provide medication and violation of personal rights are determined to be UNSUBSTANTIATED, meaning, that although the allegation may have happened or are valid, there is not a preponderance of evidence to prove that the alleged violation occurred. This agency has investigated this complaint.
An exit interview was conducted and a copy of this report and confidential names list was provided.
