Complaint Investigation Report
On September 12, 2024, CEO Rollins notified the Regional Office that Acera Health, LLC would be closing all Social Rehab Program (SRP) location operations. During this time CEO further reported that Acera Health, LLC was in the process of transferring clients to other locations and/or discharging a few clients who were completing their programs to step down programs. As of September 25, 2024, CEO reported that Acera Health LLC had changed their mind and would no longer be surrendering the licensees for three remaining properties (See license numbers: 306006072; 306006255; 306006131). At the time, CEO inquired about keeping license for Acera Health, LLC 306006305 and recanted statement of loss of control of property and stated that Acera Health, LLC retained control of property. On September 26, 2024 the Department spoke with Landlord for 1585 Miramar Drive., Newport Beach, CA 92661, whom denied that they had ever cancelled the lease with Acera Health, LLC. Landlord reported Acera Health LLC’s lease was valid until October 31, 2024 and was open to extending the lease provided Acera continued to pay their rent. Per lease agreement reviewed, lease agreement is valid until September 30, 2027.
Therefore, based on interviews conducted, LPA observations and records reviewed, the allegation that Licensee failed to notify the Department of intent to close is SUBSTANTIATED.
