Complaint Investigation Report
It was alleged that C1 was touched in the groin area by a facility staff. On 12/13/22, Interviews were conducted with the administrator and staff S2-S4, staff stated C1 did not report any incident to them of any type of sexual harassment. Interview conducted with the alleged abuser S2, stated has never touched C1 or made sexual advances. All staff indicated this was brought to their attention when a meeting was held during C1’s case workers visit. Staff also mentioned C1 suffers from memory loss due to a brain injury. Staff also stated they have cameras and did not witness any sexual abuse and cameras have been in the facility for more than 6 years. Administrator stated C1 also reported the same accusation from another facility. Interview conducted with C1 stated suffers from memory loss but stated was sexually harassed by staff S2, client stated this happened a long time ago and couldn’t remember the date. C1 stated reported to staff members but they haven’t worked for the facility in years. Interview with C2, stated has not witness any type of inappropriate behavior or touching from staff members. LPA attempted to interview C3-C4 and was unable to fully communicate.
Resident was sexually harassed by other residents at the facility.
It was alleged that C1 was walked in on the bathroom around 25 times and was touched in the groin area by a client. On 12/13/22, Interviews were conducted with the administrator and staff S2-S4, staff stated C1 did not report any incident to them of any type of sexual harassment by clients. All staff indicated this was brought to their attention when a meeting was held during C1’s case worker visit. Staff also mentioned C3 would be unable to walk in on C1, C3 needs assistant when going to the restroom and wears depends. Staff has not witness any inappropriate behavior by other clients in care. Interview conducted with C1 stated C3 has walked in the restroom 25 times and stated this happened a long time ago. C1 mentioned that C2 touched groin area twice on the patio. C1 stated this happened a long time ago and couldn’t remember the dates. C1 stated reported to staff members but they haven’t worked for the facility in years.
Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated.
An exit interview was conducted with Ms. Brady, and a hard copy of report was provided.
