10/10/2023 and conducted by Evaluator Ramsey Chimienti

COMPLAINT CONTROL NUMBER: 47-HC-20231010090113

Home Care Organization is utilizing 1099 independent contractors for caregiving shifts.

Home Care Services Branch (HCSB) Analysts, Ramsey Chimienti and Mila Quinto, arrived at the business address for Healthy at Home Caregivers on 4/11/24. Analysts Chimienti and Quinto introduced themselves and were greeted by Patricia Chikuturudzi. The analyst explained that they were there to investigate the above complaint allegation. Analysts Chimienti and Quinto interviewed Patricia regarding her company’s onboarding process for caregivers including background check and registration on the Home Care Aide (HCA) Registry. The analysts also reviewed personnel files, payroll and tax reporting documents to ensure licensing requirements are met. The documentation demonstrated that the Home Care Organization is utilizing W2 forms for all HCAs.

Based on the evidence obtained and interviews conducted, Analysts Chimienti and Quinto concluded that there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is UNSUBSTANTIATED.

Analysts concluded the visit with an exit interview and provided a copy of the HCS 9099 investigation report along with appeal rights to the Licensee.
