Complaint Investigation Report
It was alleged that staff left resident in dirty diapers for extended periods of time.
8 out of 8 resident interviews did not corroborate with the allegation by stating that facility staff assist with ensuring that residents are cleaned. 2 out of 2 staff interviews did not corroborate with the allegation. LPA observed that residents were clean, not soiled, and there were no odors in the facility that indicated that a resident was left in dirty diapers for an extended period of time. LPA was unable to obtain copies of records relevant to the allegation due to LPA Rodriguez making multiple attempts to contact reporting party, to gather additional information, however calls were not returned, therefore, further information was not provided.
It was alleged that an illegal eviction was issued.
8 out of 8 resident interviews did not corroborate with the allegation by stating that facility staff assist with ensuring that residents are cleaned. 2 out of 2 staff interviews did not corroborate with the allegation. LPA observed that there was an eviction notice that was issued to resident 1 (R1) due to non-payment, to which the Department was notified and approved the eviction for R1. LPA was unable to obtain copies of records relevant to the allegation due to LPA Rodriguez making multiple attempts to contact reporting party, to gather additional information, however calls were not returned, therefore, further information was not provided.
It was alleged that failed to meet resident's needs.
8 out of 8 resident interviews did not corroborate with the allegation by verifying that staff do meet the resident’s needs by specifying that staff assist with feeding, dressing, bathing, cleaning, medication management, medical and dental care, and also stated that in addition, staff will assist with leisure needs (regarding activities – such as obtaining supplies, or assisting with technology inquires).2 out of 2 staff interviews did not corroborate with the allegation. During the tour of the facility, LPA observed residents to be happy, and taken care of.
Based on LPA’s interviews which were conducted, review of documents obtained, and observations, LPA is unable to ascertain if the allegation occurred as reported. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove or refute the alleged violation occurred; therefore, this allegation is deemed UNSUBSTANTIATED.
