The inspector’s account

Law Enforcement conducted an investigation which indicated C1’s conservator declined further investigation and suspended their investigation, LPA obtained a copy of the Ross Valley Police Departments narrative report. Interview with C1 indicated incident happened at day program contradictory to C2’s statement the incident occurred in C1’s room. Interviews with staff (S3 & S4) revealed they did not have prior knowledge of incident and believed it happened somewhere else and that C1 & C2 have now been separated from being together most of the time. None of staff interviewed indicated they were aware of the incident until after law enforcement informed. Facility has separated both clients from riding the same bus, sitting at same dining table, separated some of clients days of day programs, made all staff aware of situation and are conducting more checks on clients, and replaced couch on 2nd floor landing with hard chairs in Peterson Hall. LPA’s interviews with parties revealed conflicting information of the incident. There was not enough evidence to prove a violation occurred. Therefore, the allegation Facility staff did not prevent resident from inappropriately touching another resident in care is Unsubstantiated .

A finding that the complaint allegations are unsubstantiated means that although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore the allegations are UNSUBSTANTIATED.
