The inspector’s account

It was alleged that Staff #1 (S1) touched Client #1 (C1) on their “private parts.” No further details were provided. LPA and QAS interviewed Regional Director (RD) Joanna Gonzalez who stated that on 11/12/2025, they received a message from C1 who expressed that S1 was being mean to them because S1 did not allow C1 to eat staff snacks/candy. C1 then asked if S1 would be suspended for this to which RD said no. Around one hour later, C1 called RD and said they have a concern and need to make a report because in the morning on 11/12/2025, S1 touched C1 inappropriately on their private parts. C1 stated that S1 and C1 were never alone in the room and other staff were present. C1 then stated that the incident never occurred and C1 only made the report because they were upset about the staff candy. RD spoke to S1 and the other staff present who stated that nothing unusual happened on 11/12/2025 besides C1 getting upset about staff candy which S1 redirected C1 to other snacks/candy for the clients. LPA and QAS interviewed C1 who stated that nothing inappropriate happened from S1 or other staff, and there are no concerns with staff’s treatment towards C1. LPA interviewed two (2) staff who were present during the incident on 11/12/2025 and no concerns were noted. Staff did not observe S1 to touch C1 inappropriately. LPA also reviewed S1’s training which was up to date and included topics such as sexual harassment for employees, conflict resolution, ensuring client dignity, and understanding sexual harassment. On 11/14/2025, the facility submitted an incident report and Adult Protective Services (APS) report regarding the allegation to CCLD, NLACRC, C1’s responsible party, and APS. Based on interviews and record review, the information obtained during the investigation does not have sufficient evidence to corroborate the allegation. Although the allegation may have happened or is valid, there is not sufficient evidence to prove the alleged violation did or did not occur, therefore the above allegation “Staff touched resident inappropriately” is deemed UNSUBSTANTIATED at this time.
