Complaint Investigation Report
It was reported that "Facility staff failed to provide proper supervision to clients" as it was alleged that Client #1 (C1), was dropped off at the incorrect address and staff were not aware resulting in C1 standing unsupervised and wandering the streets. Interviews and record reviews revealed that Client #1 (C1) was dropped off in front of the driveway between the facility and the home next door, located to the left of the facility when facing the front door. C1 was seen using their phone and talking to a neighbor, who informed C1 of the facility's location. Administrator, Syuzanna Shirinyan, stated that they were on the phone with C1, who mentioned they were outside. Administrator and staff then exited the facility to greet and assist C1. Additionally, administrator noted, now when a client is scheduled to be dropped off, they instruct the driver to enter the facility's driveway, where staff will be waiting outside to greet the client . Additionally, video footage obtained did not have time stamps to verify how long C1 was outside. However, the video footage did show that C1 was walking while on the phone. Based on the information obtained during the investigation, the Department does not have sufficient evidence to corroborate the allegation. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the above allegation, “Facility staff failed to provide proper supervision to clients” is deemed Unsubstantiated at this time.
Regarding the allegation “Conduct inimical”, it was alleged that Marketing Manager (MM), Anthony Movscsyan, bribed a neighbor to not report any incidents or concerns to Licensing. Interviews and video footage reviewed indicated that before the facility was licensed, MM spoke with a neighbor and was heard saying, "We'll do something special/sweet for you." When asked about this comment, MM explained that they intended to give gift baskets to the neighbors as a friendly gesture and was not intended nor did MM realize it could be seen as a bribe. MM stated they will avoid offering any gifts in the future. In interviews with the neighbors, it was confirmed that since that conversation, no gift baskets or other gifts have been provided. Additionally, administrator stated that she has advised all staff to limit communication with the neighbors to avoid any miscommunication in the future . Based on the information obtained during the investigation, the Department does not have sufficient evidence to corroborate the allegation. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the above allegation, “conduct inimical” is deemed Unsubstantiated at this time.
