Complaint Investigation Report
Allegation: Staff did not intervene when resident threatened another resident in care. It is alleged that two days before Halloween 2024 resident (R2) began to act aggressively; banging on walls, hitting the counter and cussing at resident (R1). It was reported that resident (R2) threatened resident (R1) multiple times while the resident resided in the home, but staff brushed off R1's concerns by saying R2 was harmless. On an unknown date, resident (R2) was holding an electric razor chasing resident (R1) and allegedly threatening R1's life in the presence of two staff, both of whom no longer work at the facility. A total of five (5) staff were interviewed. All staff denied the allegation and acknowledged that both residents (R1 & R2) did not get along with each other because resident (R2) liked a quiet environment and resident (R1) felt R2 complained too much. According to staff, both residents had behaviors that triggered each other. Staff stated that if residents behaviors are aggressive in nature they redirect, then call Administrator or 911 emergency if needed. Administration staff stated they were aware an incident that occurred on 10/28/24 at approximately 11 PM, in which R1 threatened to beat up R2 with a belt. None of the staff interviewed stated they had no knowledge of the incident in which R2 allegedly threatened R1's life when chasing the resident around with the razor. There are presently two residents residing in the home. Resident (R2) was interviewed and acknowledged they did chase R1 with an electric razor and made grunting noises for fun. Resident (R2) stated that R1 did not take the joke well and once staff told the resident to stop, the resident obeyed and then went to their room. Resident (R2) reported general anger issues, but never hit or threatened R1. Resident (R3) confirmed that resident (R2) chased R1 with an electric razor, but stated that R2 was joking around and R1 laughed too. Resident (R3) stated that the incident escalated when a staff person called R1 "client instead of resident."
LPA obtained an 8 second video of the alleged threatening incident. The video shows resident (R2) walking around the kitchen island towards R1 saying "I am going". Two staff are present, the female staff is heard laughing. The video clip audio did not have audio of R2 threatening R1's life, but it does show staff giggling at the incident. The incident did not show aggression. There is insufficient evidence to prove whether staff tried redirecting R2 prior to and after the video was recorded by R1.
